Kallas and Whatley Appointed Co-Lead Counsel for Providers in the Blue Cross Antitrust Litigation


            Edith Kallas and Joe Whatley were appointed co-lead counsel to represent the Provider Class in the Blue Cross Antitrust Litigation.  The Litigation challenges the market allocation agreements and other anticompetitive practices of the Blue Cross entities that dominate the market for health insurance.  The Panel on Multi-District Litigation centralized the dozens of related cases before Judge David Proctor in the United States District Court for the Northern District of Alabama.  MDL No. 2406.

Joe Whatley said “this case presents an important opportunity to advance health care reform by loosening the stranglehold that the Blues have in so many of the health insurance markets in this country.  The litigation presents the opportunity to correct the problems in those markets and fix situations like we have in Alabama where Blue Cross controls roughly 90 percent of the business.”
