Blue Cross to Allow HIV/AIDS Patients to "Opt-Out" of Mandatory Mail-Order Rx Drug Program

In a settlement approved today in San Diego, California, Anthem Blue Cross patients with HIV/AIDS may “opt-out” of a program that would have required them to obtain their medications by mail order and forego the benefits of their retail specialty pharmacy.  The lawsuit, filed by WhatleyKallas, LLP and Consumer Watchdog, alleged that the discriminatory program would pose serious health and privacy threats to HIV/AIDS patients receiving specialty medications. The California Insurance Commissioner applauds the court’s decision to suspend Anthem’s requirement that its HIV/AIDS patients only use a mail order pharmacy.  For the Commissioner’s full press release please visit here.
