WHATLEY KALLAS FILES SUIT ALLEGING CVS DISCLOSED HIV STATUS OF 6,000 OHIOANS

On March 21, 2018, Whatley Kallas, on behalf of John Does 1-3, filed a class action lawsuit against CVS, one of the nation’s largest pharmaceutical benefit managers, and its vendor Fiserv.  The Complaint alleges that they had disclosed the HIV status of 6,000 patients enrolled in the Ohio HIV Drug Assistance Program, which provides assistance to low-income participants, through a mailing that improperly referred to "HIV" that could be clearly seen through a windowed envelope.
