JUDGES PROCTOR AND PUTNAM TO HOLD STATUS CONFERENCES IN BLUE CROSS ANITRUST CASE

US District Judge R. David Proctor, and Magistrate Judge T. Michael Putnam have each scheduled status conferences for Tuesday, January 15, 2019 to discuss the next steps and scheduling for the In re: Blue Cross Blue Shield Antitrust Litigation (MDL 2406).

Judge Proctor’s conference will begin at 9:30 AM at the Hugo Black Courthouse, and will focus on the schedule going forward, and other matters following up on the Court’s recent ruling that the Blues’ market division conspiracy will be evaluated using the per se standard.

Judge Putnam’s Discovery conference will begin at 1:00 PM, at the Courthouse, and will focus on finalizing discovery issues including privilege review and upcoming Expert discovery.

The Litigation challenges the market allocation agreements and other anticompetitive practices of the Blue Cross entities that dominate the market for health insurance.  Joe Whatley and Edith Kallas are Co-Lead Counsel for the Provider track of the litigation and represent Healthcare Providers of all types throughout the country.  Those Providers include doctors, ancillary providers, ambulatory surgery centers, and hospitals.

We will provide further updates on the status of the case after the Court’s conferences.
