JUDGES HOLD STATUS CONFERENCES IN BLUE CROSS BLUE SHIELD ANTITRUST LITIGATION

               On January 15, 2019, Judges R. David Proctor and T. Michael Putnam each held their first status conference in the Blue Cross Blue Shield Antitrust Litigation (MDL 2406) since the 11th Circuit Court of Appeals denied the Blues Petition to Appeal Judge Proctor’s Order regarding Standard of Review.  In those conferences setting a class certification schedule, the next steps on privilege review and discovery, as well as issues related to the upcoming Anthem v. Cigna trial in Delaware Chancery Court were all discussed.   The Court expressed interest in moving forward with class certification in the near future.  We will update once the Court enters a Scheduling Order with respect to the streamlined Alabama action.
